NOTICE OF PENDING ORDINANCE

PLEASE TAKE NOTICE that the foregoing ordinances were introduced and passed on first reading by the Township Committee of the Township of Hopewell, County of Cumberland, New Jersey at a meeting held January 29, 2026 and the same was then ordered to be published according to law with a public hearing and a vote scheduled for the meeting of March 12, 2026 beginning at 6:30 p.m. at the Hopewell Township Municipal Building, 590 Shiloh Pike, Bridgeton, New Jersey, 08302 at which time all interested persons will be heard. Copies of the ordinance can be obtained, without cost, by any member of the public at the Municipal Clerk’s Office between the hours of 8:30 a.m. and 4:00 p.m.


ORDINANCE #2026-02

ORDINANCE AMENDING THE LAND USE AND DEVELOPMENT FEE ORDINANCE OF THE TOWNSHIP OF HOPEWELL, CUMBERLAND COUNTY TO ADD THE RESIDENTIAL INCLUSIONARY OVERLAY DISTRICT IN FURTHERANCE OF THE FAIR HOUSING ACT

The proposed ordinance effectuates the intent and purpose of the goals and objectives of the adopted and endorsed Fourth Round Housing Element and Fair Share Plan of the Township of Hopewell. The intent of this ordinance is to create the RIO Residential Inclusionary Overlay zone to provide the opportunity for inclusionary affordable housing. The RIO zone would apply in the R-2 and R-3 Zoning Districts and would be intended as an overlay district permitting higher density development and a variety of housing types provided certain conditions are met in an application for development, thus ensuring adequate water and sewer are provided.

Section 1. Definitions

Section 220-3, Definitions, shall be amended by adding the following definition:

LAND USE BOARD: The Planning Board pursuant to N.J.S.A. 40:55D-25.c(1).

Section 2. RIO Zone (Residential Inclusionary Overlay)

The Residential Inclusionary Overlay, shall be added to Chapter 220 of the Code of the Township of Hopewell at §220-29.K as follows:

(1) Purpose

The Residential Inclusionary Overlay (RIO) is intended for residential development with a variety of housing types serving various segments of the population and with a significant inclusionary affordable housing component…

(5) Area, Yard, and Coverage Requirements

Requirement Standard
Maximum Dwellings per Building (Townhouses) 6 dwellings
Minimum Distance from Building front to Building front 60 feet
Maximum Height – townhouse 3 stories
